When people he was close to couldn’t pay their medical bills he wasn’t frugal at all. He’d pay whatever if someone in his family was sick. I think he paid an enormous amount when a child of a not so well off relative had cancer.

I understand the legal difference. I'm not talking about the legal damages here, I'm talking about the practical reality of it.
I'm a lawyer specializing in criminal law (though not in Japan.) I've been working in this field now for more than 20 years. And I did a lot of work in social sciences before that, including the sociology of crime and deviance. I think about this stuff a lot.
Laws don't exist for the sake of having laws; there are reasons for them. Criminal laws can serve a number of different obxtives: Protecting public safety, deterring future crime (by both the individual offender who's being charged as well as the public at large), rehabilitation, restitution (reimbursing the victim), and retribution (the idea that someone "deserves" to be punished).
Instead of responding reflexively -- "he broke the law, therefore he should be punished" -- stop and think about whether doing so would further the above obxtives to the extent that it's worth the cost of arresting and/or prosecuting this person.
It's a complex analysis, and there's usually no easy answer, but thinking about it in this fashion is much more worthwhile than mindlessly invoking the law.

I have a somewhat related story.
A few weeks ago, my wife ordered a small coffee at 7/11. The guy gave her (and charged for) a medium cup. She pressed the S button without realizing, but noticed once the coffee barely filled the cup. She told the guy and he got the manager. The manager poured the coffee out, washed the paper cup, dried it with a paper towel, then handed it back to her to push the M button.
It took her a minute to register how weird this was. She went back inside and yelled at the manager. Long story short, we can't go to that (very conveniently located) 7/11 anymore.
They are pretty serious about their coffee.
