UK to discriminate between EU countries on fees for work visas

A diplomatic offensive is underway to ensure the U.K. does not discriminate against any EU country with its post-Brexit work visa fees, which are more expensive for the nationals of five member states than for the rest of the bloc.

Following the end of free movement, European Economic Area nationals must apply for a work visa in order to take up a job in Britain. But not all of them pay the same.

The citizens of 25 countries — including 21 in the EU — are subject to a £55 discount in fees when applying through several visa routes, including those targeted at entrepreneurs, health care staff, researchers, charity workers, medium-skilled workers and temporary workers such as fruit pickers. Employers also save money when recruiting from these countries, as companies are not asked to pay the £199 fee needed to issue a certificate of sponsorship to hire them.

Irish citizens do not need work visas because of the Common Travel Area with the U.K., but five EU countries are not eligible for reduced fees: Bulgaria, Estonia, Lithuania, Romania and Slovenia.

Some of these EU countries are now demanding help from the European Commission to tackle the difference, arguing Brussels cannot allow the U.K. to breach the EU’s long-standing principle of non-discrimination among member countries.

“In our view, this is a differentiated treatment that needs to be carefully scrutinized,” one diplomat said. “The issue is not about the additional £55 that the five member states citizens will need to pay compared to other EU citizens, but clearly about the differentiated treatment that they are faced with.”

The British government argues its eligibility list is based on the signatories of the Council of Europe’s Social Charter (CESC), an international treaty dating back to 1961 adopted by 26 countries including the U.K.

Article 18.2 of the charter sets an obligation for signatory countries to “simplify existing formalities and to reduce or abolish chancery dues and other charges payable by foreign workers or their employers.”

But the EU diplomats question the U.K.’s interpretation of this charter, saying not all the EU countries who signed it declared themselves bound by Article 18.2, yet many are still eligible for reduced fees for U.K. visas. That is the case for Croatia, the Czech Republic, Finland, Hungary, Latvia, Malta and Portugal, among others.

The diplomats also counter that all five EU countries not currently eligible for reduced fees ratified a revised charter at the turn of the century, which also includes the obligation to cut or abolish visa fees. “These are two instruments with basically the same aim that exist in parallel,” the first diplomat said.

However, the U.K. government insists its policy is based on the original treaty of the Council of Europe, and argues that reducing visa fees for any country where this is not related to an international obligation would itself raise questions of discrimination.

“Visa, immigration and citizenship fees are set at a level that helps provide the resources necessary to operate our border, immigration and citizenship system,” a spokesperson for the country's Home Office said. “In fairness to U.K. taxpayers, it is only right that those who directly benefit from our immigration system contribute to its funding. We will be considering visa fees in the round as part of our longer-term review of funding the immigration system.”

The EU envoys are piling pressure on the Commission, saying this is the first example of the U.K.’s post-Brexit immigration rules treating EU nationals differently on the basis of their nationality. They warned post-Brexit Britain is likely to discriminate between EU citizens in other looming mobility decisions, for instance, when it decides whichcountries can participate in its Youth Mobility scheme — currently open to nine developed economies outside the bloc.

A spokesperson for the Commission said that while the EU and the U.K. are free to determine their respective visa policies, “the U.K. has committed in the Trade and Cooperation Agreement to treat all nationals of EU Member States equally for the purposes for the purposes of short-term visas” and “cannot decide to grant a visa waiver for short-term travel to citizens of certain Member States, whilst excluding others.”

However, it may be hard for Brussels to find a legal basis to compel London to address the difference of treatment when it comes to long-term visas, which are not covered by the Brexit deal. “We regret that the U.K. decided to treat EU citizens differently in this specific case,” the spokesperson said.

Unresolved mobility issues are likely to be decided bilaterally between the U.K. and EU national governments — potentially leading to a patchwork of differing rules across the bloc.

“In a couple of years’ time, depending who has negotiated what, different EU citizens will have different access to different programs and at a different cost,” a third diplomat said.

The same diplomat added: “The reduced visa fees controversy is just the first issue of a number of them which are simmering beneath the surface but will come to the fore sooner or later. It will be interesting to see if there’s going to be EU-wide coordination on this or not. It all goes back to: Are we all the same or suddenly we are not? Are we going to live up to EU solidarity? Are we going to stick together? There’s no EU competence on this so it throws the ball back to member states.”

Can the EU even do something about it? I mean I know there is supposed visa reciprocity in EU rules, and the deals should cover ALL countries, but I'm not sure this goes as far as fees, and also even when it comes to just visas, the EU can't do much, like people from Romania, Bulgaria and Croatia still need US visas...
They’d have to issue an EU passport if they wanted to get rid of those discrepancies. I’m getting screwed over as well, I’m a Dutch citizen but I’ve lived in the U.K. for most of the past decade. I’d qualify for a U.K. passport but the Dutch govt doesn’t allow dual citizenship outside of a few exceptions. All of my EU friends who’ve been here for 5+ years have applied for a British passport over the past years and I can’t since I’d lose my Dutch passport. Fucking unfair.

I know the Germans have the same problem. But they allow dual citizenship if it means hardship. Just state your case I the Dutch embassy and ask if it's possible to get an exception in some way.
It's hard but I don't think it's impossible. Especially in the current political clima.
Unfortunately they won’t make exceptions on a case by case basis. It’s only allowed if you acquire citizenship through marriage or if you were born in the country and lived there for a long time as a child or if you can’t give up your other citizenship (some countries such as Morocco don’t allow their citizens to renounce their citizenship).
It’s really annoying since I have 0 desire to ever move back to the Netherlands anyway but I don’t want to lose my citizenship since I might have to move back some time to care for my parents or for work or an other unforeseen reason. I also wouldn’t want to take away the chance of EU citizenship to my children further down the line. It’s so ridiculous that an “open” and “tolerant” country such as the Netherlands is so backwards when it comes to citizenship.
So basically only for "Refugees" and not for natives. Lol Western Europe is soooo fucked up.

What are you on about? This has nothing to do with refugees. Moroccan citizens in the Netherlands aren’t refugees, their parents or grand parents were invited as guest labourers after the second world war to rebuild the country. Again, NOTHING to do with refugees.
Also has nothing to do with Western Europe. Moroccan citizens everywhere in the world can’t give up their Moroccan passports. A Moroccan citizen with dual nationality in the US or in Australia or wherever also is forced to keep their Moroccan citizenship.
Do they actually strip your citizenship or just not recognise dual nationality?
They strip it. The moment you’d want to renew your passport you’d get in trouble. I’m not sure if the U.K. shares that data with the Netherlands but lying about it could get you in trouble.
For now I’m just holding onto my Dutch passport and I hope it’ll change sometime in the future. The dumb thing is, if I were to get married to a U.K. citizen, I’d be allowed to get a U.K. passport whilst keeping my Dutch one so for now I’ll just wait.

If you married a UK citizen that is the child of an Irish person, you could get the UK passport and your children could get an EU passport. Bit of a complex I guess...
doesn’t allow dual citizenship
And it's good that way. Dual citizenship is just antidemocratic.
Why do you think it’s anti-democratic?
I guess people can vote in two places. Say Poland has problems with old Polish immigration from the 70s and 80s voting, usually far right and ultra catholic and they still vote, despite not being in Poland for decades and thinking it still looks like in the com...st days. Someone who hasn't been living in a country for so many years deciding it's fate has little to do with democracy. Not sure this was his/her point, but it pisses me off.
That's why most countries require residency to vote. I can't vote in Ireland nor New Zealand because of that.
I mean there are tons of countries that have large diasporas (Ireland and Israel are the first two that come to mind) that require anyone who wants to vote in national elections to actually be in the country to vote. This sort of removes that problem, since most people wouldn’t take the effort of flying all the way back home just to vote, especially if they have been living abroad for decades.
The EU also has different visa requirements for countries who are not members of the EU differing based on the applicants country of origin...I fail to see the difference.
Purely out of interest, do other countries have different requirements for different EU countries? Obviously the EU views itself as one for this purpose, but that of course does not mean other countries do.
But why those countries get different treatment?
I don't know, probably for the same reason that we give preference to some non EU countries over others. Maybe there is more demand from these countries and they're trying to manage that? I'm not a politician so you would really have to ask someone from the UK government.
If the EU wanted to do something about this then they could subsidise the payments.
If they would apply that scheme, they have to add 7 more countries.
Anyway they will probably get some retaliation and EU will make distinctions between Scotland, England, Wales and NI.
Except there's no way to distinguish between people from England, Scotland, Wales, NI because they are all citizens of the UK. There's no such thing as a "Welsh citizen" or "Scottish citizen".
I don't think that we have anything to gain from victimising the UK as it is becoming increasingly difficult to argue that the EU is acting in good faith. The easiest way to resolve this would be for the EC to pay the €55 on behalf of those states.
I could be wrong but I think within the UK people offer distinctions between English/Scottish/Welsh and Northern Irish, internationally these classifications do not exist and instead it's British.
I dont think europeans should do those jobs anyway. They treat them like cattle, its degrading. Let the British do them.

If you mean farm jobs, Brits wont do them as the wage is exploitative for the hard work required. Farm work has some different minimum wage based on productivity that wouldn't afford anyone rent etc. Due to the ease of finding seasonal workers previously and farming subsidies it was easy to avoid raising wages to find workers. To get Brits into that line of work it would have to pay more than minimum wage or people would just work at McDonalds instead.

Well here`s what those countries might to in response to this shitty behavior from the UK: the brexit deal was not yet approved by the european parliament so when this process will start then the MEP of said countries could just veto the brexit deal in retaliation for the UK being assholes.
So this is what we get for supporting UK. First chance they get to stab us in the back.
Best part is they don't even bother to give any real explanation, just a middle finger.
Therefore I say that it is a narrow policy to suppose that this country or that is to be marked out as the eternal ally or the perpetual enemy of England. We have no eternal allies, and we have no perpetual enemies. Our interests are eternal and perpetual, and those interests it is our duty to follow.

Please stop with this pathetic bullshit russian agenda you keep trying to push everywhere on this subreddit or atleast don't reply to me. UK has always been an ally and always will be, even if there are hiccups along the way.
Why would anyone want to go to UK to work?

Don't know, ask one of the 4.9 million EU citizens who have already applied for settled status here
It's a fairly rich western European country with low unemployment and with English as its official language. Should be quite obvious why it appeal to many people.

Because the salaries are some of the highest in the world. But so is the cost of living so.....
Depends very much on where you live. London, obviously, plus Edinburgh, Oxford, Cambridge, Bath, Bristol. Otherwise I'd say it's pretty comparable with most of western Europe. Food and drink is cheap (unless you shop at Waitrose of course).
I guess this is what they voted for, control of their borders, so it shouldn't be surprising.
But why discriminate?
These policies are not really discrimination, after all, a country doesn't have the same geopolitical agreements with every other country. They make some special agreements with some, and not for others. It really depends on the interests of the nation. There are countries now that limit Chinese investment because they don't want to end up like certain African nations. Every country already decides which country requires a visa and which doesn't, this is nothing new.
This is hardly a big deal, they’ve refused 5 countries In the EU a £55 discount.
The poorest ones. This is purely a racist deterrent for those dirty Eastern Europeans.
